Lasting Power of Attorney
None of us like to consider the prospect of becoming mentally incapable of managing our own affairs. Yet we all know it happens. We believe it is better that you decide, in advance, who will look after you and your finances should you be afflicted in this way, rather than a person not of your choosing being appointed.
The way to do this is by making a Lasting Power of Attorney. This is a legal document or set of documents that allow you as the “donor” to appoint up to four family members, friends or even ourselves to manage your affairs as your “attorney”.
The Lasting Power of Attorney must be registered with the Office of the Public Guardian before being used, affording protection to vulnerable people and discouraging any abuse of the power. Do not be concerned – if you remain perfectly capable throughout your life, the power is never needed.
You may choose to have either a “Property and Financial Affairs LPA”, granting permission for your attorney(s) to act only in relation to your property, bank/building society etc OR a “Health and Welfare LPA” limiting permission so your attorney(s) may act only in relation to health related matters.
